Kirra Wajer's choking charge withdrawn in alleged domestic violence attack

A woman who allegedly bashed her boyfriend in a vicious drunken attack had a win in court after her most serious charge was dropped.

A woman who allegedly assaulted her boyfriend in an “liquor-fuelled” attack now only faces summary offences after a choking charge was withdrawn. 

Kirra Leigh Wajer, 31, had her domestic violence charges downgraded in the Adelaide Magistrates Court to property damage and assaults. 

Her choking charge was dismissed. 

During her bail application in February, the court heard Ms Wajer and the alleged victim had been in a “dysfunctional and emotionally abusive” relationship for six months and were living together.

A prosecutor told the court Ms Wajer and her boyfriend had a “liquor-fuelled argument” on December 29, 2022 at Elizabeth Downs over the accused being involved in drug offences.

“The defendant then attacked the victim by shoving him backwards multiple times,” the prosecutor alleged.

Ms Wajer then allegedly punched the victim once to his jaw before using a broom to smash a window.

“The defendant then punched him again … before grabbing him around the neck with her arms and wrapping her legs around his waist forcing him to the ground,” the prosecutor alleged.

“At this time the defendant’s grip was around the victim’s throat and has held sufficient enough force that the victim has felt like he was on the verge of passing out and was struggling to move.”

The court heard the alleged victim began swinging his arms around and eventually Ms Wajer’s grip was released.

Michael Lloyd, for Ms Wajer, told the court at the time the alleged victim only sustained a graze on his forehead and marks on the back of his neck.

“He didn’t need any medical treatment in relation to these injuries,” he said.

“I’m instructed that the accused was hit numerous times by the defendant, she had facial injuries.”

Ms Wajer's charges were adjourned to the Elizabeth Magistrates Court in June.
