A knife-wielding man grabbed his partner by the throat and lifted her off the ground in a drunken rage, before threatening to slit the throats of her two young children.

‘No-brainer’ to make domestic violence leave a right

A man grabbed his partner by the throat for close to a minute, before threatening to slit her children’s throats in an alcohol-fuelled attack.

Jack Dwayne Wundenberg, 27, avoided jail in the Adelaide District Court on Monday for the assault that had a significant lasting impact on his ex-partner.

The court heard Wundenberg got into an argument with his victim on June 10, 2019 at Wall Flat.

“You were intoxicated … you started pushing her around the kitchen,” Chief Judge Michael Evans said during sentencing.

Wundenberg refused to let the victim leave the kitchen, demanding that she give him a phone number he wanted.

“You grabbed her around the throat with your right hand, lifting her off the ground and pushing her against the wall,” Judge Evans said.

“You continued to hold her with your right hand for about 40-50 seconds before letting her go, where she slumped to the floor.”

The court heard Wundenberg who had grabbed a knife during the argument, threatened her children, who were home at the time.

“You said to her ‘give me the number or I’m going to slit their throats with a knife’,” Chief Judge Evans said.

The Wall Flat man had previously pleaded guilty to aggravated assault and threatening to kill or endanger life.

The court heard Wundenberg had written a letter of apology to the victim, speaking of his remorse.

“You accept that your actions were irrational and totally unacceptable,” Chief Judge Evans said.

“The victim indicated the impact that your offending has had on her, including causing her to be frightened to live alone … being fearful for her children.”

The court heard Wundenberg, who had significant drug and alcohol issues, had spent 20 days in custody for the offending.

“The period you spent in custody remains with you as a significant reminder of the consequences of uncontrolled anger,” Chief Judge Evans said.

The court heard Wundenberg is working and in a new relationship.

Chief Judge Evans said society would not tolerate violence against vulnerable people.

He sentenced Wundenberg to one year and two months’ jail, with a non-parole period of seven months.

It was suspended on a three-year good behaviour bond, with supervision for two years.
