A father and son kicked, punched and stomped on a man in Adelaide, leaving him with serious injuries, claiming he’d exposed himself to women and kids.

Two men have dodged jail after they bashed a man in a vigilante attack, leaving him with serious injuries, because he allegedly exposed himself in public.

Fuelled by rage, Trevor James Lindsay, 34, and his father Michael Raymond Lindsay, 60, stomped on, kicked and punched the victim in their “cowardly” attack.

The Adelaide District Court heard the victim was walking away on Whitmore Square on May 12, 2020 when Trevor ran up behind him and repeatedly punched him to the face, knocking him to the ground.

“After he went to the ground you kicked and stomped on his body and head,” Judge Heath Barklay said during sentencing.

“While the victim was on the ground with Trevor Lindsay kicking him you, Michael Lindsay, joined in and kicked the victim.

“You both then punched him to the head while he was on the ground.”

The victim suffered serious injuries, including a fracture, swelling and bleeding from his nose and mouth.

“Your explanation for the offending was that prior to your attack the victim, who had been drinking with a group of people associated with you, had exposed his genitals in front of the group including women and children,” Judge Barklay said.

“There is no doubt that his actions were provocative and understandably produced a sense of outrage in both of you.

“However, that is no excuse for the violent, dangerous and … cowardly actions that followed.”

The court heard the offending made the victim “scared of everybody” and now has to use two walking sticks to help him walk.

“That you would act in such a way is something that both of you should reflect upon, but given what I perceive to be your lack of remorse I doubt that you will,” Judge Barklay said.

Both Adelaide men pleaded guilty to causing harm with intent to cause harm.

The court heard Michael volunteers at a day care centre designed for Aboriginal children and has a leadership role within the Aboriginal community.

Judge Barklay sentenced Michael to two years and ten months jail, with a non-parole period of one year and ten months.

“There was a high degree of gratuitous and unnecessary violence … in your case you joined in on an attack on a defenceless man,” he said.

Judge Barklay sentenced Trevor to two years and nine months’ jail, with a non-parole period of one year and nine months.

“It was you who initiated the attack on the victim … your offending was sustained and protracted,” he said.

Both sentences were suspended on a three year good behaviour bond, with supervision for two years.
