A Nuriootpa man accused of tasering two people appeared to scoff at a magistrate during a court hearing.

Police allege Morey Fiorita, 48, approached a woman in a hotel car park on February 23, before tasering her while she was still in the car.

When a bystander tried to assist, the court heard the defendant allegedly tasered the man and then ran from police.

At Elizabeth Magistrates Court on March 3, Mr Fiorita appeared via video link from Yatala Labour Prison.

He is charged with aggravated assault, damage to a motor vehicle, breach of bail and trespassing.

Sergeant Lorne Matthews said the alleged victim’s pain was so bad that “she started off in the driver’s seat and ended up in the passenger seat” during the attack.

Sergeant Matthews told the court the prosecution did not object to home detention if Mr Fiorita was to wear an ankle bracelet

“So we could monitor exactly where he goes,” Sergeant Matthews said.

Mr Fiorita’s council, Tim Dibden, asked Magistrate Edward Stratton-Smith to take into account special circumstances.

Mr Dibden said Mr Fiorita was in danger of having his house repossessed if he could not make his mortgage payments by March 9.

“We would like to permit his release to home detention, but any breach will result in him being remanded in custody without any other opportunity for release,” Mr Dibden said.

Magistrate Stratton-Smith said he had serious worries about the alleged crimes.

“On the basis of facing an imminent loss of house, at his age, I’m prepared to apply special circumstances but I am obviously very concerned at these allegations - the seriousness of them,” he said.

Mr Fiorita appeared to make a scoffing noise on camera, causing the magistrate to raise his voice slightly.

“Mr Fiorita, I hope you understood what Mr Dibden just said - he is not joking,” Magistrate Stratton-Smith said.

Mr Fiorita was released on home detention with an ankle bracelet and he will appear again in court at a later date.
