Birdwood woman challenges Adelaide Hills Council’s rooster eviction notice in court

The father of an Adelaide Hills woman resorted to keeping a diary of how many times her roosters crowed in a fight against a council order to remove the noisy birds from her property.

A Birdwood woman is fighting an order to remove a number of roosters from her property following numerous noise complaints.

Cassandra Louise Bamford received a nuisance abatement notice from Adelaide Hills Council in September last year.

According to documents kodged with the Environment, Resources and Development (ERD) Court the roosters were “impacting onto the peace and comfort of surrounding residents”.

The council then fined her $500 last December after she failed to remove the roosters.

“You are again advised to remove all roosters from the land,” a council letter to Ms Bamford read.

A council ranger had noted the roosters crowing 40 times in one hour.

When Ms Bamford asked to see the ranger’s “crowing diary”, she was told she would have to lodge a Freedom of Information request.

Ms Bamford then argued her father, Malcolm Houseman, kept a diary between November 28 and December 31 last year which found the average number of individual crows per day, between 10am and 6pm, was 26.

She also said she had not received any evidence of excessive crowing, just allegations from the council and neighbours.

“Make the claim, provide the proof,” she wrote in a statement.

In a further letter to the council ranger, Mr Houseman said his daughter had been harassed by the council.

“If it continues, legal action to stop (it) will be instigated,” Mr Houseman wrote.

He said the ranger’s reported number of 40 crowings in one hour was “dubious”.

A conference in the ERD Court has been set for July 16.
