Licensing boss warns venues after Red Square, Fat Controller avoid virus prosecution

SA’s liquor licensing boss says venues are on notice despite two popular nightclubs escaping fines after video appearing to show patrons ignoring pandemic rules emerged.

The state’s liquor licensing boss has warned venues face “significant” fines and crackdowns for COVID-19 failures despite two Adelaide nightclubs escaping prosecution for breaches.

Liquor and Gambling Commissioner Dini Soulio advised venues were “on notice” to comply with coronavirus directions, particularly patrons staying seated while drinking alcohol.

His intervention came as SA Health revealed the ban on drinking and dancing in the same venue would continue indefinitely.

Under emergency laws, individuals caught breaching directions issued by Police Commissioner Grant Stevens face a $1060 fine and businesses $5060.

Authorities say serious, or repeated, breaches will be prosecuted and fines of up to $75,000 issued, while licences could be revoked.

Mr Soulio said ignorance was no excuse given “the significant amount of publicity involving venues that have failed to enforce or comply” with the rules.

“All licensees ... face significant expiation fees from (SA Police) for non-compliance, and risk action being taken against their licence,” he said.

Mr Soulio considered prosecuting Hindley Street club Red Square and The Fat Controller on North Terrace over COVID breaches in July.

Detectives obtained Red Square footage showing the venue operating as a nightclub with drinking and dancing to loud amplified music. Footage showed revellers at Fat Controller dancing in a mosh pit.

Police fined both clubs $5060. After threatening to suspend their licences, Mr Soulio has now permitted them to trade under new operational plans.
